These Terms of Service govern your use of Time Past Antiques Shop's website and restoration services. By using our services or website, you agree to be bound by these terms.

Acceptance of Terms

By accessing our website, requesting our services, or engaging with Time Past Antiques Shop in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services or website.

Description of Services

Time Past Antiques Shop provides professional antique restoration services, including but not limited to:

  • Furniture restoration and refinishing
  • Ceramic and porcelain repair
  • Clock restoration and repair
  • Metal polishing and refinishing
  • Artwork restoration and conservation
  • Leather restoration and conditioning
  • Consultation and assessment services

Service Agreement and Estimates

All restoration work is performed based on written estimates and service agreements. Key terms include:

  • Estimates are valid for 30 days from the date of issue
  • Work will not commence without written authorization from the client
  • Any changes to the scope of work require written approval and may affect pricing
  • Timelines are estimates and may vary based on material availability and project complexity
  • We reserve the right to refuse service for any reason

Payment Terms

Payment terms are as follows:

  • Consultation and initial assessment are provided at no charge
  • For projects under $1,000: Full payment due upon completion
  • For projects $1,000-$2,500: 50% deposit required, balance due upon completion
  • For projects over $2,500: Payment schedule will be outlined in the service agreement
  • Payment is due within 30 days of invoice date
  • Late payments may incur interest charges of 1.5% per month
  • We accept cash, check, and major credit cards

Client Responsibilities

As our client, you agree to:

  • Provide accurate information about your antique pieces and their history
  • Disclose any previous restoration work or damage
  • Ensure items are clean and free of hazardous materials before delivery
  • Arrange for safe transportation of items to and from our workshop
  • Make timely payments according to agreed terms
  • Inspect completed work promptly and report any concerns within 7 days
  • Follow provided care and maintenance instructions

Liability and Risk

While we take every precaution to protect your valuable items, restoration work involves inherent risks:

  • We maintain comprehensive insurance coverage for items in our care
  • Our liability is limited to the declared value of the item or the cost of our services, whichever is less
  • We are not liable for pre-existing damage or conditions not disclosed during assessment
  • Some restoration processes may reveal hidden damage or structural issues
  • We will notify you immediately of any unexpected discoveries and obtain approval before proceeding

By engaging our services, you acknowledge these risks and agree that restoration work is performed at your own risk.

Warranty

We provide the following warranty on our restoration work:

  • One-year warranty on workmanship for all restoration services
  • Six-month warranty on mechanical function for clock restoration
  • Warranty covers defects in our restoration work only
  • Warranty does not cover normal wear and tear, misuse, or new damage
  • Warranty is void if the item is worked on by another party

To make a warranty claim, contact us within the warranty period with photographic evidence of the issue.

Cancellation and Refund Policy

You may cancel your restoration project at any time before work begins for a full refund of any deposits paid. Once work has commenced, cancellation fees may apply based on work completed and materials used. Completed work is non-refundable. For detailed refund terms, please see our separate Refund Policy.

Intellectual Property

All content on our website, including text, images, logos, and design elements, is the property of Time Past Antiques Shop and is protected by copyright and trademark laws. You may not use, reproduce, or distribute our content without written permission. We may photograph your items before, during, and after restoration for documentation and marketing purposes, with your consent.

Privacy and Confidentiality

We respect your privacy and maintain confidentiality regarding your antique pieces and personal information. Our Privacy Policy, incorporated by reference, governs the collection and use of your personal information. We may share information about your items with specialists or suppliers as necessary to provide our services.

Force Majeure

We are not liable for delays or inability to perform our services due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, labor disputes, material shortages, or other unforeseeable events. In such cases, we will work with you to reschedule or modify services as appropriate.

Dispute Resolution

Any disputes arising from these terms or our services will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in Whatcom County, Washington. You waive any right to participate in class action lawsuits or class-wide arbitration.

Governing Law

These Terms of Service are governed by the laws of the State of Washington, without regard to conflict of law principles. Any legal actions must be brought in the courts of Whatcom County, Washington.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on our website with an updated effective date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. The unenforceable provision will be replaced with an enforceable provision that most closely reflects the original intent.
